Sweepstakes, Contests, & Giveaways: Keeping Your Client’s Promotion Legal

POSTPONED UNTIL FURTHER NOTICE.

Lori Krafte of Wood Herron & Evans LLP

We’ve long seen promotions on the back of cereal boxes and other consumer packaged goods, but now there is hardly a type of business where we don’t see them, including B2B.

But as great as they are for marketing, they can create real exposure if you aren’t careful.  When is your client’s promotion actually an illegal lottery?  When is it creating unacceptable infringement or false advertising risks?  What is required to comply with the law?  How do social media platforms affect the structure and rules of the promotion?

We’ll go over the compliance basics and discuss the common pitfalls of sweepstakes, contests, and giveaways.
