Our presenter will be Dr. Matt Barton from Forresters. Dr. Barton will present on  the Unitary Patent and the Unitary Patent Court.

This presentation will give insights and guidance for both litigators and prosecutors. Particularly, Dr. Barton will discuss what qualifies as a Unitary Patent and discuss the process for how applicants can obtain and maintain a Unitary Patent. Dr. Barton will also examine the Unified Patent Court (“UPC”), including the scope of the UPC’s jurisdiction, the structure of the UPC, and the format of UPC proceedings. 

This event will include 60 minutes of presentation, and the event space will be booked for additional time for informal networking. Lunch will be provided.

About the Speaker:

Dr. Matt Barton is a partner with Forresters, based on their Munich office. Dr. Barton specializes in drafting and prosecuting patent applications in Europe, the UK and around the world, with particular experience of patent prosecution at the European Patent Office. He has extensive experience of EPO opposition and appeal matters as well as litigation support. He regularly prepares patentability reports and freedom to operate opinions for his clients. His practice focuses on chemistry, but he handles a broad range of subject matter including patents for foodstuffs, medical devices, alloys, metallurgy, spectrometry and personal care products together with a wide variety of mechanical subject matter. Dr. Barton is a member of the Royal Society of Chemistry as well as a foreign member of the American Intellectual Property Law Association (AIPLA) and leads the International Patent Practice Subcommittee of AIPLA’s Chemical Practice Committee.

This presentation will give insights and guidance for both litigators and prosecutors. Particularly, Mr. Luken and Mr. Molloy will discuss the practical and legal implications of cases concerning topics such as eligibility under Section 101, written descriptions under Section 112, licensee appellate standing, nexus requirements for secondary considerations, induced infringement, and fair use.

About the Speakers:

John Luken focuses his practice on patent infringement litigation and appeals, as well as complex commercial and other intellectual property litigation. He has handled patent infringement cases involving a variety of services and products, including commercial forms and related software, software-related business method patents in the printing and financial services industries, metal beverage cans and closures, surface coal mining blasting methods, liquid beverage concentrates and related packaging, automated barge refurbishing methods, service station petroleum equipment, and retail security products.

Matthew Molloy is admitted to practice before the United States Patent and Trademark Office and has extensive experience in the preparation and prosecution of patents in the U.S. and abroad. He manages international patent portfolios and his practice encompasses a variety of technical areas such as chemical/chemical engineering, materials, polymers, petroleum refining, pharmaceuticals, biotechnology, mechanical engineering, software, and business methods.

Our presenter will be Ted Davis from Kilpatrick Townsend & Stockton LLP. Mr. Davis will present on Trademark and Unfair Competition Law Developments. 

Speaker Ted Davis will discuss developments in trademark and unfair competition law over the trailing twelve months, including: 

• The effective date of most (but not all) of the Trademark Modernization Act;
• Constitutional challenges to the appointment of the TTAB’s administrative law judges;
• Significant opinions addressing the question of liability for infringement arising from the resale of genuine, but altered or diverted goods;
• Ratification of the initial-interest confusion doctrine;
• Judicial disapproval of transparently opportunistic claims of priority;
• Significant opinions from the Trademark Trial and Appeal Board invalidating registrations as fraudulently procured; and
• Ex parte orders from the Acting Director of the USPTO and the Commissioner for Trademarks sanctioning bad actors.

About the Speaker:

Ted Davis is a partner in the Atlanta office of Kilpatrick Townsend & Stockton LLP, where he has practiced trademark, copyright, false advertising, and unfair competition law since 1990. Outside the office, he has taught as an adjunct professor at the Emory University and the University of Georgia schools of law and has testified before Congress on trade dress and Internet issues. He is a past member of the International Trademark Association’s Board of Directors, a past chair of the American Bar Association Section of Intellectual Property Law, and a past chair of the American Intellectual Property Law Association’s Trademark Law Committee. As a frequent amicus advocate, he has represented INTA, the ABA, and the AIPLA in a number of briefs submitted to the U.S. Supreme Court.

Ted received his undergraduate degree from Davidson College and his law degree from the University of Virginia. He is a member of the Georgia, New York, and District of Columbia bars.
