The expansion of the Internet has led to an expansion in IP infringement claims stemming from content posted or otherwise shared via the Internet.From blogs and websites to social networks, it has become increasingly common for IP rights to be infringed. Mike Hurst, Partner at KMK, will address some of the most prevalent issues facing clients today. In particular, Mike will discuss rules for when you can use others’ content without violating their copyright, how trademarks of others can be legally used online, and techniques for leveraging the content of others without breaking the law. Mike will also discuss how the various take-down policies that have been put in place by social networks, such as Twitter, Facebook, and Pinterest are similar, as well as how they differ, and what these policies mean to both lawyers and their clients.

Lawyers have traditionally donated their time through pro bono legal work and other community service. The aspiration to serve runs deep in the legal profession, to the point that it is expressed in our professional creed. Many lawyers desire to serve others in one way or another, but are challenged with finding the time and the best way to make an impact. The program will include a discussion of a lawyer’s calling to community service, the role of the lawyer in the community, and whether community service for lawyers should relate to legal issues. We will also discuss various projects and organizations seeking community service volunteers, and we will hear from one organization, Dress For Success (DfSC), regarding how one might get involved with their organization.

CincyIP would also like to take this opportunity to ask our members to give back to those that are less fortunate through Dress for Success during this holiday season. The program will cover differences between Science Fact and Science Fiction, and how each may be used to call into question the patentability of subject matter claimed in patents and patent applications. Specifically, Tom will discuss the concept of prior art, both under the old Patent Law and under the new America Invents Act, the level of operability required to constitute prior art, and the standard of review in litigation compared to the standard of review in prosecution. Tom will also lead an analysis of several questionable patents and applications by applying the principles discussed.

Thomas E. Lees is owner of Thomas E. Lees, LLC, a law office in Dayton, Ohio. Tom holds a B.S. degree in Electrical Engineering with option in Computer Science from The Ohio State University (1992) and a J.D. degree from Capital University School of Law (1998) (Order of the Curia, several CALI awards). Tom has extensive patent prosecution experience in electrical as well as computer and Internet related technologies and has been in private practice since 1998. Prior to entering private practice, Tom worked as a systems and software engineer designing proprietary precision forecasting software and real-time RF integrated systems. Tom’s practice emphasizes client counseling regarding U.S. and foreign patent matters including portfolio management, prosecution and IP enforcement. Tom’s practice further includes preparation of patentability, infringement, clearance and validity opinions. Tom’s practice also includes the areas of licensing, trademarks, copyrights, branding and intellectual property litigation and support.
