This course has been approved by the Supreme Court of Ohio Commission on Continuing Legal Education for 1.0 total CLE hour instruction (1.0 Ethics Hours).

Geof and Judge Fischer will lead a discussion regarding the ethical implications of using social media whether in day-to-day use by the intellectual property practitioner, throughout the course of prosecution or litigation, in enforcement of IP, or even in negotiating IP transactions. The speakers will discuss how the traditional Model Rules of ethics are being interpreted when applied to social media by Ethics Boards and the Courts to help practitioners properly navigate the murky waters of today’s social media world.

The panel will discuss various strategies for protecting intellectual property surrounding software. They will provide insight as to when patent protection may be desirable and when another type of protection may be more suitable, the efficacy of copyrights to protect software-related IP, and how the recent Federal Circuit cases of Noah v. Intuit and Ergo Licensing v. CareFusion will change how software patents are drafted. The panel will also provide thoughts on how the software industry is impacted by non-practicing entities and open source trends.

On September 16, 2011, President Obama signed into law the Leahy-Smith America Invents Act, a bipartisan, bicameral bill that updates our patent system to encourage innovation, job creation, and economic growth. The last major patent reform was nearly 60 years ago. Our panelists will discuss various changes that The Act implements, how the changes have already impacted the way their organizations do business, and how they envision The Act changing the future of the patent system, both positively and negatively. By representing the points of view of the USPTO, a large corporation, and a trade organization, the discussion will further highlight the varying impact of The Act on different organizations invovled in the patent system, and create awareness for attorneys regarding the wide arrray of issues that they may encounter when working with a variety of clients and other individuals.
