Martin Ludwig, Director of Trademarks and Licensing at the University of Cincinnati, will speak on collegiate licensing and brand management. Mr. Ludwig will cover general information from relationships with sideline partners like Adidas, Nike, and Under Armour, product category/distribution, and enforcement activities in the U.S. and Internationally. Mr. Ludwig will also discuss current events such as Ohio State’s recent filing with the USPTO to block Horseshoe Cincinnati’s registration for “The Shoe”, enforcement efforts for market events like the NCAA Tournament, and, if time allows, international registrations with universities expanding programming abroad.
Ted Davis, a partner in the Atlanta office of Kilpatrick Townsend & Stockton LLP, will present on developments in trademark and unfair competition law over the trailing twelve months, with a particular emphasis on the invalidation under the First Amendment of the prohibition in Section 2(a) of the Lanham Act on the registration of potentially disparaging marks, continued judicial disagreement on the evidentiary value of registrations on the Principal Register, and emerging applications of the Supreme Court’s opinion in B & B Hardware, Inc. v. Hargis Indus., 135 S. Ct. 1293 (2015).
