Developments in Trademark and Unfair Competition Law

Join us on January 9th, when Ted Davis, a partner in the Atlanta office of Kilpatrick Townsend & Stockton LLP, will discuss developments in trademark and unfair competition law over the last twelve months.

Mr. Davis’s remarks will focus on the invalidation of the Lanham Act’s prohibition of registration of potentially disparaging marks on First Amendment grounds, variation among federal circuit courts on the prerequisites for accounting of defendants’ profits, the continued implications of Octane Fitness v. Icon Health and Fitness, and continued findings of fraud on the USPTO by courts (but not by the Trademark Trial and Appeal Board).

About the Speaker:

Ted Davis divides his practice between domestic and international litigation and client counseling in the fields of trademark, copyright, false advertising, and unfair competition law and has particular experience in trade dress and gray market disputes, litigation before the Trademark Trial and Appeal Board, and with large-scale trademark clearance and registration projects. He is a past chair of the American Bar Association Section of Intellectual Property Law, on behalf of which he has testified before Congress on trademark and Internet issues, and he also has served as a member of the Board of Directors of the International Trademark Association, which he has represented in a number of amicus filings before the United States Supreme Court.  He has been recognized by numerous organizations for his work in the area of IP.  Mr. Davis is a frequent author on intellectual property topics, and his articles have received the Ladas Memorial Award (three times) from the International Trademark Association, as well as the Burton Award for excellence in legal writing.
