November 13, 2012
12:00pm– 1:30pm

1.0 total CLE hour instruction (Pending)

The program will cover differences between Science Fact and Science Fiction, and how each may be used to call into question the patentability of subject matter claimed in patents and patent applications. Specifically, Tom will discuss the concept of prior art, both under the old Patent Law and under the new America Invents Act, the level of operability required to constitute prior art, and the standard of review in litigation compared to the standard of review in prosecution. Tom will also lead an analysis of several questionable patents and applications by applying the principles discussed.
